I am the parent or legal guardian of the above-named child and give permission for my child to participate in the Penticton Indian Band Sun Fun 2026 Program. I understand that program activities may include, but are not limited to:

Recreational activities and games

Community outings and excursions

Transportation by approved vehicles or buses

Cultural teachings and activities

Land-based learning opportunities

Arts, crafts, and educational activities

Parks, playgrounds, and community facilities

Water-related activities where parental consent has been provided

I understand that Penticton Indian Band staff will provide supervision and take reasonable precautions to promote the safety and well-being of participants throughout the program. Assumption of Risk I understand that participation in recreational and community-based programs involves inherent risks that cannot be completely eliminated. These risks may include, but are not limited to:

Slips, trips, and falls
Minor cuts, bruises, or sprains
Injuries resulting from recreational activities
Risks associated with transportation to and from activities
Risks associated with outdoor activities and changing weather conditions
Other unforeseen incidents that may occur despite reasonable supervision and safety measures

I voluntarily assume these risks on behalf of my child and authorize their participation in the Sun Fun 2026 Program.

Medical Information and Emergency Authorization
I certify that, to the best of my knowledge, my child is physically able to participate in the activities associated with the Sun Fun Program, subject to any medical information disclosed on the registration form.
In the event of illness, injury, or medical emergency, and when I cannot be reached immediately, I authorize Penticton Indian Band staff to obtain emergency medical treatment for my child as deemed necessary by qualified medical professionals.
I understand that every reasonable effort will be made to contact me or my emergency contact as soon as possible.
Release of Liability
I acknowledge that Penticton Indian Band, its Chief and Council, employees, contractors, volunteers, Elders, Knowledge Keepers, and program representatives will take reasonable steps to provide a safe environment for participants.
In consideration of my child's participation in the Sun Fun Program, I agree that Penticton Indian Band shall not be held responsible for injuries, losses, or damages arising from the ordinary risks associated with participation in program activities, except where such liability cannot be excluded by law.
Nothing in this agreement limits or waives any rights that cannot legally be waived under applicable law.

Participant Code of Conduct

The Sun Fun Program is designed to provide a safe, inclusive, respectful, and enjoyable environment where children can learn, build friendships, participate in recreational activities, and engage in cultural experiences.
All participants are expected to contribute to a positive environment by following these expectations:
I WILL:

Treat other participants, staff, Elders, volunteers, and community members with respect and use appropriate language and behaviour.

Follow directions provided by Sun Fun staff and volunteers.

Participate safely in activities and excursions.

Respect program spaces, equipment, supplies, vehicles, and facilities.

Keep my hands, feet, and objects to myself unless participating in an approved activity.

Include others and help create a welcoming environment.

Stay with my assigned group and staff during outings and activities.

Tell a staff member if I feel unsafe, uncomfortable, or witness behaviour that may cause harm to others.

Respect cultural teachings, traditions, and activities.

I WILL NOT:

Bully, threaten, intimidate, harass, or exclude others.
Use discriminatory, racist, sexist, homophobic, transphobic, or otherwise hurtful language.
Engage in physical aggression, fighting, or unsafe behaviour.
Leave program activities, facilities, or excursions without staff permission.
Possess or use alcohol, cannabis, tobacco, vaping products, weapons, or any illegal substances.
Put myself or others at risk through unsafe actions.

Behaviour Support Approach
The Sun Fun Program is committed to supporting children through positive guidance, redirection, problem-solving, and restorative approaches whenever possible.
When behaviour concerns arise, staff may:

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY

(*Please Read Carefully – By Signing this Agreement You Are Releasing Certain Rights)

IN CONSIDERATION of being permitted to participate in the 2026 SUN FUN PROGRAM,

Sponsored by the Penticton Indian Band (the “Activity") (where the Participant is a minor, references to “I”, “me”, and “my” in this agreement mean the undersigned parent or guardian, signing in their personal capacity) I, for myself, my personal representatives, assigns, heirs, and next of kin:

1. ACKNOWLEDGE, agree, and represent that I understand the nature of the Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity

2. FULLY UNDERSTAND that: (a) The ACTIVITY INVOLVES RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.

3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE the Penticton Indian Band, its Chief and Council, administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessees of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, legal fees, loss, liability, damage, or cost which any may incur as the result of such claim. Nothing herein shall be construed as a waiver of any rights, immunities, privileges, or defences available to the Penticton Indian Band under the laws of Canada or of British Columbia.

I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect. This agreement is governed by the laws of the Penticton Indian Band, the Province of British Columbia and the laws of Canada as applicable, and the courts of British Columbia have jurisdiction over any dispute arising from it.

Photo and Video Consent
I also give the Penticton Indian Band permission to photograph and video and release all images of me during this event. I am aware that photos and videoing will take place and may be distributed and/or posted within the Penticton Indian Band website and/or Facebook group pages, used for promotional material and/or reports. I understand that this consent is voluntary, that declining it does not affect the Participant’s ability to take part in the Activity, and that I may withdraw this consent at any time by written notice to the Penticton Indian Band, except in respect of images already published or distributed.
